License, Not Sale: Purchase of a Digital Asset grants you a non-exclusive, non-transferable, revocable license to use the asset under the terms outlined below. You do not own the underlying asset files. 2. Permitted Uses Personal & Commercial Use Personal Media: You may use the Digital Assets in personal projects, artwork, animations, videos, render images, and non-commercial games. VTuber & Streaming Content: You may use the assets on personal VTuber avatars or stream overlays, including monetized channels (e.g., YouTube, Twitch) and accepted tips/donations, unless explicitly stated otherwise on the individual product page. Game & Interactive Development: You may incorporate the assets into compiled, executable games, applications, or interactive media, provided the original raw asset files (.fbx, .obj, .blend, .png, .tga, .psd, .unitypackage, etc.) are securely embedded and cannot be easily extracted by end users. Modifications You are permitted to edit, recolor, mesh-edit, or adapt the Digital Assets for your own personal or allowed commercial use. Modified versions remain subject to these Terms of Conditions and cannot be resold or redistributed. 3. VRChat & Metaverse Specific Guidelines Private Uploads: You may upload avatars or worlds containing these Digital Assets to platforms such as VRChat, Cluster, NeosVR, or Resonite, provided the upload is set to Private (accessible only to your personal account). Public / Cloneable Avatars: Uploading avatars containing these assets as "Public" or making them available for cloning by other users is strictly prohibited. Public Worlds: Incorporating these assets into public VR worlds is allowed only if the asset files are compiled within the world build and cannot be ripped or extracted by visitors. 4. Prohibited Uses & Restrictions You strictly MAY NOT: Redistribute or Resell: Share, transfer, sublicense, resell, or distribute the raw Digital Assets or modified versions of the assets to any third party (including sharing via Discord, cloud drives, torrents, or file-hosting sites). Third-Party File Extraction: Sell or distribute any project file, avatar, or game where the source asset files can be extracted or accessed in their original raw formats. Generative AI Training: Use any portion of the 3D models, textures, render images, or associated files as inputs for training machine learning models, generative AI algorithms, or neural networks without explicit written consent. NFTs & Blockchain: Convert, mint, sell, or register the Digital Assets (or derivative works) as NFTs (Non-Fungible Tokens) or on any blockchain-based platform. Misrepresentation: Claim original credit or copyright ownership for the creation of the Digital Assets. Unlawful / Harmful Content: Use the assets in content that promotes hate speech, discrimination, illegal activities, harassment, or defamation. 5. Refunds & Cancellation Policy Digital Goods Sales Final: Due to the non-returnable nature of digital downloads, all purchases are final, non-refundable, and non-exchangeable once the file has been downloaded or accessed through BOOTH. (ONLY IN EXCEPTIONAL CASES a refund is issued) Defective Files: If a file is corrupted, missing data, or visually defective, please contact the shop owner via BOOTH message or Twitter (@Ema_VRC) for support or a corrected file replacement. 6. Disclaimer of Warranty & Limitation of Liability "As-Is" Basis: The Digital Assets are provided "AS IS" without warranty of any kind, express or implied, including but not limited to compatibility with specific software versions, game engines, or hardware. Limitation of Liability: The creator shall not be held liable for any direct, indirect, incidental, or consequential damages (including data loss or software incompatibility) arising out of the use or inability to use the Digital Assets. 7. Modifications to Terms The creator reserves the right to update or modify these Terms of Conditions at any time without prior notice. Continued use of previously purchased assets remains governed by the version of the agreement in effect at the time of purchase, unless a security or copyright violation requires retroactive updates.
