■ Insomnia Angel 利用規約 / Terms of Use 制作・販売：pnknkitin / あの花子 ブランド名：Insomnia Angel --- 本規約は、pnknkitin（VRC上では「あの花子」としても活動）が運営するブランド Insomnia Angel において販売する3Dモデル、テクスチャ、デザインコンセプト（以下「コンテンツ」といいます）の利用条件を定めるものです。 本コンテンツに関する著作権は、pnknkitin および Insomnia Angel に帰属し、国際的な著作権法およびDMCAによって保護されています。 --- ■ 正規販売について / Official Distribution Only 本ページまたは https://linktr.ee/pnknkitin 内に記載されているリンク以外で販売・配布されているものは、『当製作者の正規商品ではありません』。 もし類似商品や不正販売を発見された場合は、お手数ですがご報告ください。 また、違法転売防止のため、代理購入は一切お断りしております。 お一人様につき2個までの購入制限を設けております。 これらのルールを守っていただけない場合、今後のご購入を制限させていただく場合がございます。 --- ■ データ受け渡し方法について / About the Data Delivery Process 当店のアイテムは過去に何度も不正取得（いわゆる「ぶっこ抜き」）の被害に遭っており、現在も発見・対応しきれていない事例が存在します。 Unityデータを販売するにあたり、これまで以上に厳重な対策を行う必要があります。 そのため、ご購入後すぐにUnityデータを直接ダウンロードすることはできません。 代わりに、最初にダウンロードしていただくのは、手順が記載されたテキストファイル（メモ帳形式） となります。 ファイル内の案内に沿っていただくことで、Unityデータをお受け取りいただけます。 お手数をおかけいたしますが、不正利用防止のための重要な措置ですので、ご理解とご協力をお願いいたします。 --- ■ 禁止事項 / Prohibited Actions 以下の行為は禁止されています： - 購入者本人のVRC内アバター用途以外での使用 - 営利・非営利を問わず、二次配布・販売・譲渡・貸与・送信などの再提供行為 - 改変やリテクスチャを行った場合であっても、第三者への配布・販売は禁止 - コンテンツの全部または一部を使用した類似製品やクローンの制作・販売 - 外部サイト・マーケット・プラットフォーム等での販売・再販・配布 - VRChat 以外のプラットフォーム（例：ChilloutVR / NeosVR / Cluster / FiveM など）での使用 - 法人・企業・VTuber事務所等による商用利用（事前の制作者の許可がある場合を除く） - コンテンツに含まれるInsomnia Angelのロゴや表記の削除 - SNS・配信・コミュニティ等における「プレゼント企画」や「抽選企画」など、制作者の許可を得ない不特定多数への再配布行為 また、以下の用途も固く禁止します： - 名誉毀損、誹謗中傷、暴力的・差別的・違法行為の助長 - 政治的または宗教的な活動・主張・表現への利用 - その他、制作者が不適切と判断する行為 ※ 本規約に明記されていない行為であっても、記載が無いことが「許可を意味するものではありません」。 ※ いかなる国籍であっても、「言語が読めなかった」「規約を理解していなかった」等の理由によって、上記の禁止事項が免除されることはありません。 --- ■ クレジット表記について / About Credits 当ブランドのアイテムを商品画像、プロモーション画像、動画など商用目的で使用する場合は、ブランド名または Insomnia Angel の BoothページURL（https://insomnia-angel.booth.pm/）を配布プラットフォーム上（Boothなど）で必ず明記してください。 また、非商用の場合は必須ではありませんが、「#VRInsomniaAngel」ハッシュタグを付けていただけると幸いです。 --- ■ 返金・返品ポリシー / Refund Policy デジタル商品の性質上、購入後の返品・返金には対応できません。 --- ■ 規約違反について / If You Violate These Terms 本規約に違反した場合、状況に応じて弁護士を通じた法的措置を取らせていただく可能性がございます。 どうぞご理解の上、ご利用ください。 --- These Terms of Use set forth the conditions for the use of 3D models, textures, and design concepts (hereinafter referred to as “contents”) sold under the brand Insomnia Angel, operated by pnknkitin (also active in VRC as Ano Hanako). All copyrights related to the contents belong to pnknkitin and Insomnia Angel, and are protected under international copyright law and the DMCA. --- ■ Official Distribution Only Products from our brand are **only sold on this page and through the links listed at https://linktr.ee/pnknkitin**. Any items sold or redistributed elsewhere are **not official products of our brand**. If you come across similar items or unauthorized sales, we would appreciate it if you could report them to us. In addition, to prevent unauthorized resale, we do not accept proxy purchases under any circumstances. Each customer is limited to purchasing up to two items. Failure to comply with these rules may result in restrictions on future purchases. --- ■ About the Data Delivery Process Our items have unfortunately been subject to unauthorized extraction (“data ripping”) multiple times in the past, and there are still cases we have not yet discovered or been able to stop. To better protect our Unity data, it will not be available for immediate download after purchase. Instead, you will first receive a **text file (Notepad format) containing instructions.** By following the steps in that file, you will be able to obtain the Unity data. We understand this may be inconvenient, but it is an essential measure to prevent misuse. Thank you for your understanding and cooperation. --- ■ Prohibited Actions The following are strictly prohibited: - Any use outside of the purchaser's own avatar in VRC - Redistribution, resale, sharing, transferring, or lending, regardless of commercial or non-commercial intent - Redistribution even after modification, editing, or retexturing - Creating or selling similar products or clones using any part of the content - Distributing or selling the content on external websites or platforms - Use of the content on platforms other than VRChat (e.g., ChilloutVR, NeosVR, Cluster, FiveM) - Commercial or corporate use, including by agencies or companies (unless explicit prior permission is granted by the creator) - Removing or altering the Insomnia Angel logo or branding The following are also strictly prohibited: - Use for defamation, slander, hate speech, violence, illegal activity, or anything damaging to the brand - Use for political or religious activities, statements, or expressions - Any other use deemed inappropriate by the creator - Using the content in personal “giveaway” or “lottery” campaigns on SNS, streaming platforms, or communities without the creator’s explicit permission !!! Even if an action is not explicitly written in these Terms, this does not mean it is permitted. !!! Regardless of nationality, failure to read or understand the Terms due to language barriers does not exempt you from responsibility for any prohibited actions described above. --- ■ About Credits When using our items in product images, promotional images, or videos, you must include either the product name or the Insomnia Angel Booth page URL ( https://insomnia-angel.booth.pm/ ) in the credits. This also applies when posting on social media or other distribution platforms. For non-commercial use, we would appreciate it if you could add the hashtag #VRInsomniaAngel. --- ■ Refund Policy Due to the nature of digital products, we do not accept returns or refunds after purchase. --- ■ If You Violate These Terms Legal action may be taken through a lawyer if these terms are violated.
